AN ORDINANCE OF THE BOARD OF SUPERVISORS

OF THE COUNTY OF MODOC

AMENDING CHAPTER 3.06.020 OF THE MODOC COUNTY CODE

 

The Board of Supervisors of the County of Modoc ordain Title 3, Chapter 3.06.020 be amended as follows:

3.06.020 - Intercounty Disaster Relief

 

              Pursuant to the provisions of section 69.3 of Chapter 2 of Part 0.5 of Division 1 of the California Revenue and Taxation Code, the base year value of property substantially damaged or destroyed in a Governor-declared disaster may be transferred to a comparable replacement property of equal or lesser value located in Modoc County; provided, that:

 

              A.              The original property is owned and occupied by the claimant and his/her principal place                                           of residence;

              B.              The original property has sustained physical damage amounting to more than fifty                                           percent of its full cash value immediately prior to the disaster;

              C.              The comparable replacement property is of equal or lessor value than the original                                                         property full cash value prior to the disaster;

              D.              The replacement property has been acquired or newly constructed as a replacement                                           for the damaged/destroyed property within three years after the damage/destruction of                                           the original property; and

              E.              The Governor-declared disaster occurred after October 20, 1991.
